We have been carrying out minor construction work under NZS3910:2013. The contract had a 6 week contract period. During the contract period, we had some significant variations, that I requested an extension of time for and applied the working day rate. However, we still managed to finish all the work within the contract period and now the Engineers Rep has declined my EOT claim. Is he allowed to do this? Should the EOT claims not have been approved/declined as I was submitting them. They would not of known 1 week into the contract (when I started sending variations and EOT requests) that we would finish within contact period. NZS3910 does not mention what happens in these circumstances (that I can see). Any help and advice would be greatly appreciated.
